LAND REGISTRY’S LATEST RESPONSE TO MY INITIAL F.O.I. REQUEST SENT ON THE 2ND MAY 2014

For the Attention of F.V.CLOUGH, Local Land Registrar, Durham
Dear Sir,
I acknowledge and thank you for your  eight page guidance notes  type  letter I  receive yesterday,  sent  to my home address  and not as I would have preferred  to this site, WDTK , to avoid any future misunderstandings can I request that Land Registry  do not send any future  F.O.I. Correspondence to my home address but  send it to this site- WDTK to  ensure all replies to F.O.I. requests are Prominently  displayed in the Public Domain  for all to see .

I think it is also  important and  essential to Clarify  the facts that in  my origin  F.O.I. request sent to Land  Registry on the 2nd May 2014  and  still displayed on this site, I did Not repeat I did Not as  you Implied In to your Letter , request  an “Official Copy” of  MY Registered  Property  WHICH  I  already have , issued by Land Registry, Durham THEMSELVES, on the 10th October 2008, showing all the details recorded in the Register of Title on the 9th October 2008, at 10.55.27. or any other Documents, that would incur costs.

I  Simply asked for a COPY of  what the Head of Land Registry Malcolm Dawson O.B.E. Described in his letter to Iain Wright M.P. the Member of Parliament for Hartlepool as an Authentic Copy of the Original Survey Plans to have Survived AFTER all the original survey plans had been Destroyed. This could Only Refer to some other Survey Documents, as ALL Genuine Original Survey Documents of Registered Land and Property Title CE74844 Absolute” are Safely and Securely Held  in  OUR  Possession .
 
Unfortunately I still feel highly suspicious but NOT unduly Surprised that Land Registry are Unable to produce the claimed Authentic Copy of the Survey Plans that were NOT destroyed,
This could only be construed by any normal right thinking person, that Malcolm Dawson O.B.E. Head of Land Registry, a Senior Civil Servant employed by Land Registry Deliberately and Wilfully Deceived and Misinformed   Iain Wright M.P the Democratically Elected Member Of Parliament for Hartlepool,

This Disrespectable Disgraceful Conduct is Totally Unacceptable and Seriously questions Malcolm Dawson’s O.B.E. Honesty, Integrity and  Most  Certainly Questions His claim in His letter to Iain Wright M.P. to have Fully Investigated my Serious allegations of Criminality & Misconduct in Public Office by the assistant Land Registrar, Alan H Smith and others at Land Registry Durham,

I am led  to believe that Malcolm Dawson’s O.B.E. found Nothing to support my allegation of Misconduct and  Criminality ,Despite it should be Noted the Overwhelming Irrefutable Documentary Evidence available in the form of the ORIGINAL Land Title Deeds CE74844 “Absolute” Registered by J Anthony Brown, Chief Solicitor of Hartlepool Borough Council on the 29th 3. 1984 including an “Official Copy” ” of the “Register of Title” CE74844 “Absolute” issued by Land Registry Durham, THEMSELVES, on the 10th October 2008, showing all  the details recorded in the Register of Title on the 9th October 2008, at 10.55.27.

(Under s67 of the Land Registration Act 2002 this “Official Copy” is admissible in evidence to the same extent as the “Original”)
To Ignore & Cast aside this Irrefutable Documentary Evidence has Irrelevant is without a shadow of doubt an act of Desperation, Undoubtedly Intended to Deliberately Mislead and Deceive Iain Wright M.P. the Honourable Member of Parliament for Hartlepool, and to protect the Criminal activities of Dishonest Colleagues working in Land Registry Durham
It is important to remember  and I make NO apology  for repeating it that Even  IF  this “Authentic Copy” of the Original Survey Plans had  existed and  Produced for Examination and  Validation  it would still  remain JUST  THAT  a COPY  of the “Original Survey Plans” and  Could NEVER  be  given Official Legal Standing to the same extent  as an “Official Copy” of the “Register of Title” CE74844 “Absolute” issued by Land Registry Durham, THEMSELVES, on the 10th October 2008, showing all  the details recorded in the Register of Title on the 9th October 2008, at 10.55.27.
For the Head of the Land Registry  Malcolm Dawson O.B.E. to  Deceitfully Indicate Otherwise is Disgraceful and  Dishonest  this Unhealthy Situation is  a clear  indication that things are Seriously Wrong at Land Registry Durham, and in my view Highlights  another Similar Unhealthy Situation  that  exists  in both the Legal and Planning Departments of Hartlepool Borough Council.

No amount of Legal Double Talk, Blatant Lies or Letters containing Guidance Notes.  can Disguise or Hide the True Facts that things are Seriously Wrong at Land Registry Durham,  one only as to examine the B141 submitted to Land Registry in October 2008,  fraudulently attempting to ALTER  a Registered Title,  and  the Two (2)  Coloured Photographs of an Outside Toilet Door, one  in the Open and  one Closed Position , Documents later accepted by Alan H Smith the assistant Land Registrar Durham  as Greater Proof of Property Ownership than the Original Registered Land Title Deeds  CE74844 “Absolute” and an  Official Copy” ” of the “Register of Title” CE74844 “Absolute” issued by Land Registry Durham, THEMSELVES, on the 10th October 2008  To  fully realise that there was a Deliberate Deceitful attempt of Conspiracy Collusion and Collaboration between Officials in Land Registry Durham and Hartlepool Borough Council Planning Officials to Pervert the Course of Justice in Public Office and to avoid by Deceitful means the Financial costs  to the B141 applicant of Demolition of the Kitchen Extension Illegally Erected on  Freehold Land and Property NOT in their Ownership .
I believe that all Criminal Wrongdoing in Public Office should be Exposed & Reported to do Nothing is NOT an option , all allegations of FRAUD  supported with the Necessary evidence  of Wrongdoing  must be taken seriously and Investigated NOT Ignored or Kicked into the Long Grass, my allegations  quite rightly  Question  the Honesty and Professional  Integrity of ALL Employees at Land Registry Durham  and officials  in both the Legal & Planning Departments of Hartlepool Borough Council,
It should be remembered that we are the Victims of Property Fraud, we have suffered a Financial LOSS through the Criminal activities of employees of both Land Registry Durham And Planning Officials of Hartlepool Borough Council
 
It is my understanding that ANOTHER Letter Containing our  Criminal Allegations has been sent to ED LESTER the present Chief Land Registrar by Iain Wright M.P. the Member of Parliament for Hartlepool.

ED Miliband  the Labour Leader  - recently asked  in the Media, Why are the Labour Party Losing Previously Staunch Supporters to UKIP -  I believe my  Personal  Experiences described  below will give him a Clue - The Labour Party Particularly in Hartlepool,  is overflowing from Top to Bottom with Bad Apples. and Poor actors.
A Little Reminder the Name of the Game is to Name & Shame.
Here is a brief reminder of ROB COOK’S the Labour Party’s Councillor  for the DE-BRUS Ward , Giving  a Spectacular Theatrical Performance after viewing the illegally erected Horrible Carbuncle of a Kitchen Extension -  built without seeking  Planning Permission  & attached to our Private Property- had to be seen to be believed -WHO Authorised that Monstrosity he said- It Should  Be Demolished-  this  Spectacular Theatrical  performance -  with hand gestures- was unbelievable-  you must remember this  was  Prior to his Successful  election as Labour Councillor for the De-Brus Ward - Unfortunately since his election as a Labour Councillor-  he has suffered a Severe Loss of Memory  (Known as  Political Amnesia ) nevertheless,  it has established in the Memory of   this Previous Staunch  Labour Party Supporter an unforgettable scene- showing  what  deceitful  depths a Genuine Incompetent  would be Labour Politician & Compulsive Liar, would go to get votes!

This  self-important  blustering would be labour politician who instead of vigorously investigating our genuine concerns  of Property Damage- which he himself had  seen, Prior to his Successful  election as Labour Councillor for the De-Brus Ward – Deliberately  & Cowardly Conspired & Collaborated  with the other Two (2) DE-BRUS  Ward  Labour Councillors  SHEILA GRIFFIN & SYLVIA TEMPEST  to  ask  PETER DEVLIN to write a letter of Censure to me on THEIR  behalf .
In  essence the letter say’s that any further Critical Comments I wish to make Should be submitted to HIM  and  NOT to my Elected  Labour Ward  Councillors –as my Comments are a Little Unpalatable - this Unhealthy Highly Suspicious Situation  clearly indicates to me that  PETER DEVLIN an Unelected Highly Paid Hartlepool Council Official in Public Office –will decide  in future- if any  of my Critical  allegations of - FRAUD- Misconduct in Public Office – Criminal failure to implement Statutory  Regulations of the Town & Country Planning Act 1990- attempting to Pervert the Course of Justice by Council Officials in Public Office employed in the  Legal & Planning Departments are to be passed onto MY  Elected  Labour Party Ward Councillors

(c)             Allowed to Continue Operating  a Business Enterprise in their  newly Purchased Ex-Council House , although expressly Prohibited in  the Registered Land Title Covenants

 DECEITFUL PLANNING OFFICERS

I firmly believe that Richard Trow case planning officer of Hartlepool Borough  Council  was the main instigator of this carefully orchestrated blatant attempt to obtain a certificate of lawfulness by any deceitful dishonest means available to him, he was in a position of trust and Influence - a position he unashamedly  exploited for his own ends , he believed that without any involvement  of any of the elected  council planning committee he had unlimited powers – he believed he was above the law- untouchable-  he could walk on water, and  with the  willing assistance of his colleague  Mr.Reece development control manager  he took full  advantage of their  unique  positions  of Delegated   Authority & Responsibility and  “GRANTED”  the Controversial  Retrospective Planning application  H/2009/0568  Although both  these senior Planning Officials were fully aware that  part of the  building  of  a kitchen extension  had been illegally erected on  a neighbours Registered Freehold Private Land and Property  & was Definitely  NOT in the Ownership of the Retrospective planning applicant.
A blatant criminal  breach of the Town and Country Planning Act 1999, sections 65 (5) and 65(6)

It Should  be remembered, it was  Richard Trow  Hartlepool Councils Planning Officer, who  had  admitted to me  at the  Meeting  held in  Brian Hanson House that he was the Architect/Draughtsman engaged by the Planning Applicants, Not Only to supply the detailed Drawing for the New  Kitchen Extension, but to Personally assist and advise them on how  best to obtain Planning approval from Hartlepool Planning Authority
 
Richard Trow was quite Confident  & Rightly so,  that  planning approval would be eventually  be granted,  by Hartlepool Planning Authority,  Little did I know then, that He would  be ultimately have  the  opportunity  to sit in  Judgement on his OWN  Planning Project,  and Grant Planning Approval to the Planning applicants  H/2009/0568 despite all the Over whelming protests  & Irrefutable Documentary Legal  Evidence of Legal Registered Land & Property Owners.
 
 NOT Surprising when one considers that Both these Hartlepool Highly Paid Council Officials,Who have NO repeat NO Legal Qualifications Whatsoever, Contemptuously Dismissed as of No importance the Legal Guidance Notes for Local Council to Follow BEFORE Granting  a Certificate  of Lawfulness to applicants Seeking Retrospective Planning Permission who had Previously& Deceitfully built  Extensions   without applying for  Council Approval handed down by High Court Judge Sir Thayne Forbes when sitting in the Queen’s Bench Division on the 3rd February 2010 when Dismissing an appeal  by Robert Fidler pursuant to s289 of the Town & Country  Planning Act 1990.

I Believe that the actions of Both Richard Trow  Hartlepool  Council Planning Officer  & Mr Reece , Hartlepool Development Control Manager  were  Dishonest & Criminal in Intent , When they  deliberately GRANTED  planning permission to the   legally flawed Retrospective Planning Application H2009/0568 , I believe  they acted illegally  in Public Office with the intention of making a gain  for themselves  or  someone else  by inflicting a loss or a risk of loss on another a clear breach of s4 of the FRAUD ACT  2006,

MORE PLANNING HANKY PANKY IN MONKEY TOWN

In my view it is vitally important if not essential to understand the Major Part if not the most Important Critical Part  played  by Richard Trow   Hartlepool Council Planning Officer enthusiastically  assisted  by Mr. Reece,  the Development Control Manager who together Deliberately  Conspired to Pervert the Course of Justice when they  jointly Decided to  “Grant” a Highly Controversial Retrospective Planning Application H/2009/0568 for a friend, knowing the application was Legally Flawed.

 I Seriously Question the personal integrity   of Richard Trow and his  involvement in this Highly Controversial Retrospective Planning Application, when one considers that he  himself admitted to me at our first meeting  held in  Brian Hanson House in August/September 2008 * that he was the Architect/Draughtsman personally engaged by the Retrospective Planning Applicants NOT only to Design the Detailed Drawing for the New Kitchen Extension but to assist and Personally advise the Planning applicants on HOW Best to obtain Planning approval from Hartlepool Planning Authority,

It is Important to note that Richard Trow, was employed by Hartlepool Borough Council as a Planning Officer &  would have been or should have been  fully  Conversant &  knowledgeable on HOW, Retrospective Planning approval could  be Quietly  and Discretely achieved  for the  Disputed Retrospective Planning  application H/2009/0568 he knew it   Contained  False Claims of Property “Ownership” & was therefore  Legally Flawed.- WITHOUT - It  should  be noted , the involvement of any of the Democratically Elected Councillors on the Hartlepool Planning Committee, No Consultation, No Seeking Guidance or Legal  Advice  for such a Disputed Controversial Retrospective Planning Application

Hindsight is a wonderful thing- there can be little doubt now, WHY Richard Trow’s was so Confident and Certain at the Meeting held  in  Brian Hanson House August/September 2008 *  that the Initial  Planning application H/2008/0467 later change to that legally flawed  Controversial Retrospective Planning application H/2009 0568 would be approved & eventually granted planning permission  by Hartlepool Planning authority,

He Himself Richard Trow Hartlepool Councils Planning Officer  on assuming  personally responsible for this Project H/2009 0568 assisted by Mr Reece Control Planning Manager  would use  HIS  Delegated  Power of Authority in the total  absence of the Hartlepool Planning Committee to decide the final outcome of this Highly Controversial Retrospective Planning Application.

A  Very Unhealthy  Situation  for a  Council Officials to be placed in, there is always the Suspicion even  the  Possibility which has happen before- that Council  Officials Particularly Planning Officers  when dealing with a Strongly Disputed  Controversial  Retrospective Planning application as H/2009/0568  could be offered and have  accepted  some  kind of inducement it need not be money, to adopt a dishonest course of action  by  Granting Planning approval for a Strongly  Disputed  Retrospective  Planning  Application, although fully Conscious  that this Particular Retrospective Planning application  Contained False Claims of Property “Ownership” & was therefore  Legally Flawed.

Imagine  the following  Scenario,  a  School Boy Placed in a very Similar Position, alone in his classroom WITHOUT  any School Teachers  present  being allowed to Alter or Mark  his  OWN  Examination Papers, would it be a Complete and Utter Surprise  to find the School Boy had passed his examination with flying colour, even Top Marks .

It is Important to keep in mind,  that Richard Trow the Planning Officer for this Project had been informed on Numerous Occasions has had Hilary Martin, F,O.I. Officer,  Alyson Carman, Solicitor & Complaints Reviewer, (who had requested &  been given  an Official Copy of the Register of Title in  December 2008 )  and  Paul Burgon, Enforcement Officer, that the Retrospective Planning applicants H/2009/0568 – had  NOT  repeat had NOT Purchased from Hartlepool Borough Council in 1972,  any of the Disputed  Property, and therefore DID NOT repeat DID NOT OWN any of the Freehold Land & Property their Illegally built Kitchen Extension  had  been Built on,

It is also important to Remember that both Richard Trow Planning Officer and Mr Reece, Development Control Manager, were Both Well Paid Senior Council Planning Officials employed in Positions of Trust in  Public  Office, although  neither were Legally Qualified. it was NOT in my view, Unreasonable for members of the General Public to have expected BOTH these Highly Paid  Senior Council Officials employed by Hartlepool  Borough Council in the Planning Department  to have  at Least a  Basic Working Knowledge  if  NOT  Fully Conversant with the Town & Country Planning Act 1990, & Both  Should have known  that Ownership Certificates A.B.C & D. are a Statutory Requirement under Sections 65(5) of the Town & Country Planning Act 1990

I was also Informed In answer to a Freedom Information request I made to the Office of the Secretary of State for Communities and local Government, the Right Honourable ERIC PICKLES M.P.  

It is  a Criminal Offence under Section 65(6) of the Town & Country Planning Act 1990 to issue a Certificate Knowing it Contains False or Misleading information.

The local Planning authority, in this case, Richard Trow, the Hartlepool Council Planning Officer, assisted by   Mr. Reece, Development Control Manager, KNEW  or Should  Have KNOWN they   “Must Not Entertain” an application for Planning  Permission  Unless  the Relevant Certificates  Concerning  the Ownership” of the Applicants  Site have been Completed  Stating the “Ownership” of the Property

 NONE of the above named Labour Councillors have sought fit to acknowledge or even attempted to contact me to explain .WHY my Serious Criminal  Allegations have been Ignored, Instead  they collectively instructed PETER DEVLIN believed to be the Chief Solicitor of Hartlepool to write to me to me to say in essence ,that if I have any other Critical Comments  to make, I should submit them to him first & NOT  to my elected ward Labour Councillors,
This is Freedom of Speech Hartlepool  NEW LABOUR   Style, an obvious attempt to  TRY and INTIMIDATE  or  FRIGHTEN this  OLD FART, they know I am an OCTOGENARIAN  & Hope I will Just Fade Away,
They  ALL Know  a Simple visit to my Home as was undertaken by ROB COOK ( a Genuine Incompetent  would be Politision  Compulsive Liar ) prior to his election  as the De-Brus Ward Councillor,   would quickly establish and Prove my Allegation Correct.

There can be no room for Misunderstanding or Further Doubts when one considers the Previous favourable & Extra Special treatment given to this Particular Retrospective Planning Applicant H/2009/0568

(a)            Being allowed to Operate a Business enterprise from a Council House , Strictly Prohibited in  Council Tenancy agreements

(b)            Allowed to Purchase their Council House Property in 1972, at a Time of a Critical National Shortage of Social Housing- a Privilege denied to others.

(c)             Allowed to Continue Operating  a Business Enterprise in their  newly Purchased Ex-Council House , although expressly Prohibited in  the Registered Land Title Covenants

Shocking - Unbelievable  - BUT TRUE - Once you get over your initial shock, you will no longer doubt MY Allegations that All  the Undermentioned Council Officials , Richard Trow, Planning Officer, Hilary Martin, F,O.I. Officer Alyson Carman, Solicitor & Complaints Reviewer, (who had requested &  been given  an Official Copy of the Register of Title in  December 2008 and  Paul Burgon, Enforcement Officer, Conspired -Collaborated with the Retrospective Planning Applicants H/2009/0568 to Pervert the Course of Justice, & to Falsely Claim  by Criminal Deception “Ownership” of Registered Land & Property NOT in their Registered Title !

Please Note, If anything I have Written or Published is NOT TRUE – Why have NONE repeat NONE  of the  named Hartlepool Council Individuals Disputed any of my allegations, NOR Commenced ANY Legal Proceeding against ME for Slander, or whatever other crimes they can think of, BUT remember  a Council Cannot Sue for Libel ( Derbyshire  vs  Sunday Times , House of Lords. 1993 ) NOR can it Indemnify a Councillor or Council Officer who wishes to Sue an Individual (Local authorities  indemnity  for Members and Officers ) order 2004 ?
