NAME and SHAME -PREFERENTIAL-PRIVILEGED-TREATMENT-IN-HARTLEPOOL

One would have to be Completely Brain Dead not to have noticed that corruption in Hartlepool Borough Council is widespread-  reported allegation of Misconduct by Council Officials is treated with complete indifference -even by elected councilors- who even  when presented with irrefutable evidence to  support the allegations – have no hesitation in kicking such allegations into the long grass- and then run to the Chief Solicitor to complain that a  victim of council corruption has had the audacity to complain to them-

A typical example is without doubt Rob Cook Elected Labour Councilor for the West-View - DE-BRUS Ward he seems to have quickly forgotten that he was elected to specifically represent the interests and concerns of the DE-BRUS Ward Constituents- evidently that was a widely circulated cynical myth he and his friends put about before his  election- but  no longer valid after election -no one cares anymore- honesty and Integrity are dirty words  to Councilors-  except a few concerned enthusiastic decent victims still seeking and waiting for justice.

 Even simple requests for information submitted to the Freedom of Information Officers are simply ignored- the idea is I believe quite simple- if they ignore you long enough they assume you will eventually get fed up flogging a dead horse  and go away- this kind of dishonesty and Ignorance is unfair on all  those innocent decent  people involved.

 

I recently wrote again  to my Member of Parliament Iain Wright M.P. just to remind him how disappointed I remain simply because he has neglected to make any comment  on any  of my  Serious allegations Of Criminal Misconduct by employed Officials of Hartlepool Borough Council, Hayley Martin F.O.I. Officer-Alyson Carman Solicitor and Complaints reviewer - Mr Reece Development Control Manager and Paul Burgon the Enforcement Officer - all you will note are-  Paid Council Officials employed in the Planning and Legal Departments  of Hartlepool Borough Council

 

All the above named Council Officials Conspired Colluded- and deliberately ignored  Government Guidelines – and showed  once again Favouritism- Preferential Consideration and Extra Special Treatment  to a Retrospective Planning applicant H/2009/0568 and Granted  a Certificate of Lawfulness to that Particular Retrospective  Planning applicant - fully aware that it was Legally flawed-

The Retrospective Planning application H/2009/0568 contained  false- misleading -dishonest  claims that they were the legal owners  of that part of the Private Freehold Land and Property Registered Title CE74844 “Absolute” on which they had deceitfully erected without seeking Planning Permission from Hartlepool Borough Council or Consent of  the Legal Registered Owners-  part of their Kitchen Extension -a Blatant – Deliberate Fabrication -and a clear Breach of A Statutory Obligation. i.e. Sections

                  65(5) & 65(6) of the Town and Country Planning Act 1990

I personally submitted a request to Hayley Martin Freedom of Information Officer employed by Hartlepool Borough Council on the 11^th January 2011 still available on this Blog. http://alanflounders.blogspot.co.uk

 requesting a Copy of all the documents consulted regarding Ownership of the Freehold Land and Property the Retrospective Planning applicant H/2009/0568 falsely and Dishonestly claimed  were in their Registered Ownership-and according to Hayley Martin Freedom of Information Officer- had been Initially Inspected and Validated as Correct by Hartlepool Borough Council Planning Officials.

 If you believe that you will believe anything

 

I am still awaiting a reply- WHY- you may reasonably ask- am I still awaiting a reply-WHY have Hartlepool Borough Council Officials continued to ignore my reasonable and courteous request for a Copy of the Ownership Documents A.B.C. or D- documents the Planning authorities had claimed to have Inspected and Validated as Correct- That statement made by Hartlepool Borough Council Officials is a Deliberate Blatant Deceitful Lie.

 

The Retrospective Planning applicants H/2009/0568 had NEVER repeat NEVER ever  Purchased from Hartlepool Borough Council, any of the Registered Freehold  Land and Property Title  CE74844 “Absolute” Private Property  on which they had built their illegal  Kitchen Extension on--

Why you might ask would anyone goes to such extreme lengths to achieve by Criminal Deception a Certificate of Lawfulness for a Retrospective Planning application H/2009/0568, what would motivate a number of Hartlepool Council Officials  to deliberately Lie –and willfully assist the Retrospective Planning applicant to achieve by deception their objectives--I believe the Motive for such Underhanded Deception  is very easy to understand - ? Think about it !

 

What is certain is had the Retrospective applicants H/2009/0568 been refused a Certificate of Lawfulness – by Hartlepool Planning Authority- as they rightly should have been- and had Hartlepool Borough Council - enforced their legal obligations – to Protect the Financial Interest of the Legal Property Owners of Land Title CE74844 “Absolute then the Consequences for the Retrospective Planning applicants could have been horrendous the possible Demolition of the Ugly

 Carbuncle of a Kitchen Extension build without permission  and had  attached it  onto and causing Damage to the  Private Registered Land and Property- CE74844 “Absolute- the financial costs incurred by the Retrospective Planning applicants H/2009/0568 to demolish their illegal  kitchen extension  would have been astronomical- ? Does any level headed normal person still doubt that my allegations that the  Retrospective Planning Applicant H/2009/0568 was shown Special Preferential and Privileged Treatment and what inducement  was employed to receive that Special Treatment ? - I leave you to make up your own mind- more to come shortly - in the mean time Read more on Name and Shame on

While I appreciate your Support in my dispute with Land  Registry- and  forwarding  a copy of my criminal allegation to Ed Lester, Chief Land Registrar,    I am Disappointed to  note  that you have NOT Commented on  any of my other Serious allegations Of Criminal Misconduct by Hayley Martin, Alyson Carman, Mr. Reece or  Paul Burgon - all  Paid Council Officials employed in the Planning and Legal Departments of Hartlepool Borough Council who Conspired and Colluded to “Grant” a Retrospective Planning application H/2009/0568, Knowing the Planning application Contained False & Misleading Claims of  “Property Ownership” a Blatant & Deliberate Breach of Sections 65(5) & 65(6) the Town& amp; Country Planning Act 1990. 

Here for your Information your Files and  Records is an UPDATE  Describing  ROB COOK’S Spectacular Theatrical Performance I posted on  the Internet on  Wednesday 18/6/2014 that Confirms I believe my allegations that Dishonesty & Corruption incompetence and Validates that  Preferential  Treatment  is still endemic in Hartlepool Council 

Here is a  brief reminder  of  ROB COOK’S Spectacular Theatrical Performance after viewing the illegally erected Horrible Carbuncle of a Kitchen Extension -  built without seeking  Planning Permission  & attached to our Private Property- had to be seen to be believed - who Authorised that  Monstrosity  he said- - It Should  Be Demolished-  his  Spectacular Theatrical  performance -  with hand gestures- was unbelievable-  you must remember this  was  Prior to his Successful  election as Labour Councillor for the De-Brus Ward - Unfortunately since his election as a Labour Councillor-  he has suffered a Severe Loss of Memory ( Known as  Political Amnesia ) nevertheless,  it has established in the Memory of  a Previous Staunch  Labour Party Supporter an unforgettable scene of what  depths a Genuine Incompetent  would be Labour Politician & Compulsive Liar, would go to get votes!

This  self-important  blustering would be labour politician who instead of vigorously investigating our genuine concerns of Property Damage-   which he himself had  seen, Prior to his Successful  election as Labour Councillor for the De-Brus Ward – Deliberately & Cowardly Conspired & Collaborated  with the other Two (2) DE-BRUS  Ward  Labour Councillors  SHEILA GRIFFIN  and SYLVIA TEMPEST  Requested  PETER DEVLIN to write a letter of Censure to me on  their  behalf in essence saying that any further Critical Comments I wish to make Should be submitted to HIM  and  NOT to my Elected  Labour Ward  Councillors – this Unhealthy Highly Suspicious Situation  clearly indicates to me that  PETER DEVLIN an Unelected Highly Paid Hartlepool Council Official in Public Office –will decide  in future- if any  of my Critical  allegations of - FRAUD- Misconduct in Public Office – failure to implement Statutory  Regulations of the Town & Country Planning Act 1990- & attempting to Pervert the Course of Justice by Council Officials in Public Office  employed in the  Legal & Planning Departments are to be passed onto  MY  Elected  Labour Party Ward Councillors , a decision I believe is both Unhealthy –Certainly Intended to be Intimidating if not frighten an elderly Octogenarian in poor health, & Breaches  my Human &Legal  Rights  Particularly  Article 10, Human Rights Act 1998 Freedom of Expression

 ED Miliband  the Labour Leader-  recently asked Why are the Labour Party Losing Previously Staunch Supporters to UKIP -  I believe my  Personal  Experiences described  above  will give him a Clue - The Labour Party Particularly in Hartlepool,  is overflowing from Top to Bottom with Bad Apples.

A Little Reminder the Name of the Game is to Name & Shame the Local  Political Pond life and their Paid Friends

There can be little or No room for any Further Doubts or Misunderstanding that we were deliberately and Deceitfully Shafted -Fraudulently Deceived & Robbed of Part of our Legally Purchased - Registered Freehold Land & Property –by all the named Hartlepool Borough Council Officials. Extra Special treatment

An obvious example that highlights my allegations of Council Corruption   & the Extra Special Favourable Treatment given to a small minority but in particular to this Retrospective Planning Applicant H/2009/0568 would  be to question WHY  were they

(a)             Allowed to Operate a Business enterprise from a Council House , Strictly Prohibited in  Council Tenancy agreements from 1962-1972 

(b)            Allowed to Purchase their Council House Property in 1972, at a Time of a Critical National Shortage of Social Housing- a Privilege denied to others.

 

(c)             Allowed to Continue Operating  a Business Enterprise in their  newly Purchased Ex-Council House , although expressly Prohibited in  the Registered Land Title Covenants

Shocking - Unbelievable  - BUT TRUE - Once you get over your initial shock, you will no longer doubt MY Allegations that All  the Undermentioned Council Officials  Richard Trow, Planning Officer, Hilary Martin, F,O.I. Officer Alyson Carman, Solicitor & Complaints Reviewer, (who had requested &  been given  an Official Copy of the Register of Title in  December 2008 and  Paul Burgon, Enforcement Officer, Conspired -Collaborated with the Retrospective Planning Applicants H/2009/0568 to Pervert the Course of Justice, to Falsely Claiming   by Criminal Deception “Ownership” of Registered Land & Property NOT in their Registered Title

We are the Innocent Victims of this  FRAUD - Denied the Use of Registered  Freehold Land & Property we Purchased in all Good faith from Hartlepool Borough Council in February 1984 .

Rt. Hon Lord Denning , Lord Chief Justice  His Appeal Court Ruling January 12.13.24.1956 was –No Court in this Land  will allow a person  to keep an  advantage he has Obtained by FRAUD , NO  Judgement of a Court, NO order of a Minister can be allowed to stand if it has been Obtained by FRAUD –FRAUD unravels  everything

Please Note, If anything I have Written or Published is NOT TRUE – Why have NONE  repeat   NONE   of   the  named Hartlepool Council Individuals Disputed any of my allegations, NOR Commenced  ANY Legal Proceeding against ME for Slander, or whatever other crimes they can think of. BUT they should   remember they will have to use their OWN Money.

NOR CAN a Council Indemnify a Councillor or Council Officer who wishes to Sue an Individual (Local authorities   indemnity   for Members   and  Officers ) order 2004

Registrar, eventually produces more Truthful and Fruitful answers to my Allegations of Serious Criminal Misconduct by the assistant Land Registrar Alan  H  Smith and other Officials employed
 at Land Registry Durham, than the Fictitious and Deceitful Reply you received  from the Previous  Head of Land Registry Malcolm Dawson O.B.E when he deliberately stated  in his letter to you
that the original documents/survey plans had been destroyed  BUT an Authentic  Copy  (Not  you will note an Official Copy, under s67.of the Land Registration Act 2002- an Official Copy of the Register of Title is admissible in Evidence  to the same extent  as the Original ) had survived –
 This statement, I believe was a deliberate lie, a blatant attempt  to divert your attention away from
 the  real truthful issues, of Criminal Misconduct and attempting to Pervert the  Course of Justice in
 Public Office

I submitted a Freedom of Information request to Land Registry on the 2nd MAY 2014 requesting a “Copy” of the Authentic Copy of the Survey Plans that Malcolm Dawson O.B.E. claimed in his letter to you MY Member of Parliament for Hartlepool, were NOT destroyed ,now appears to be Difficult if NOT Impossible to be Produced for Inspection by Land  Registry and can only be Construed
by any Right Thinking Normal Person  to be an admission that the authentic copy  of the origin survey plans DOES  NOT exist and therefore Malcolm Dawson O.B.E. Head of Land
Registry Wilfully  Deliberately and Intentionally  Lied to the Democratically Elected Member of Parliament for Hartlepool Iain Wright M.P. to divert his attention away from the True Serious Allegations of Criminal Fraudulent Misconduct in Public Office by Alan H  Smith assistant

He Claimed to have found no evidence to Support MY Allegations of  Criminal Misconduct
Despite the Overwhelming Irrefutable Documentary Evidence  available in the Form of the Original
Registered Land Title Deeds CE74844 “Absolute” Registered at Land Registry Durham  on the
29th 3 1984 by J Anthony Brown, Chief Solicitor Of Hartlepool Borough Council.

To Cast Aside this Irrefutable Legal Documentary Evidence including an "Official Copy"  of the Register of Title CE74844 “Absolute” issued by Land Registry Durham, THEMSELVES on the
10th October 2008 showing all the details recorded in the Land Register of Title on the
9th October 2008, at 10.55.27 .as Irrelevant are Despicable acts of Desperation Intending to  Deliberately Mislead and Deceive Iain Wright M.P. the Honourable Member of Parliament for Hartlepool
One should also remember that Elizabeth Derrington the Official Complaints Reviewer also supported my allegation of Misconduct in Land Registry, Durham,
                   WHY else would she award me £300  and an Apology ?

One should also Note and Remember  the legal dictum of the Rt. Hon. LORD DENNING
The Lord  Chief Justice HIS Appeal Court Ruling in January 12.13. 24. 1956 

Still Valid Law to this Day, “ No Court in this Land ”will allow a person  to keep an advantage  which he has obtained by “FRAUD” No judgement of a Court - No  order of a Minister  can be allowed  to Stand If it has been obtained  by “FRAUD”
